The White House Council on Environmental Quality today announced its withdrawal of interim “National Environmental Policy Act Guidance on Consideration of Greenhouse Gas Emissions and Climate Change.”
CEQ issued its recommendations as temporary guidance in 2023, noting at the time that it may revise the guidance in response to public input being sought, or finalize the interim guidance.
In withdrawing the interim guidance, CEQ notes its inconsistency with (1) the President’s Executive Orders on Unleashing American Energy and Ending Illegal Discrimination and Restoring Merit-Based Opportunity, and (2) federal law and the interests of the United States. It also clarifies that the withdrawal does not change any law, regulation, or other legally binding requirement.
